Terms of Use

1. Parties

This Terms of Use Agreement (the "Agreement") is entered into electronically between Enjoyvent Etkinlik Biletleme ve Teknoloji A.Ş. ("Enjoyvent") and the natural person (the "User") who uses the enjoyvent.com website and the "Enjoyvent" mobile application.

2. Definitions

• Site / Application: The enjoyvent.com website and the Enjoyvent mobile application.
• User: Any natural person who visits the Site, registers, or buys a ticket.
• Organiser: The natural or legal person organising the event.
• Event: Concerts, theatre performances, festivals, sports matches, exhibitions, and similar organisations.
• Service: The digital platform service provided by Enjoyvent for intermediating the sale of event tickets belonging to Organisers.

Enjoyvent acts solely as an intermediary service provider; it is not the owner, organiser, or a direct party to the events.

3. Subject of the Agreement

This Agreement governs the User's purchase of event tickets through the Site and Application, the use of the services provided, and the determination of the rights and obligations of the parties.

A ticket purchase constitutes a contract between the Organiser and the User. Enjoyvent only intermediates this relationship.

4. User Obligations

The User agrees and undertakes the following:

• To use the Site in accordance with the law and the rules of good faith
• To provide accurate, up-to-date, and complete information when registering
• Not to create an account or make payments using someone else's information
• To keep account information confidential and not share it with third parties
• To be responsible for all transactions made through the account
• Not to resell, reproduce, or distribute tickets for commercial purposes
• To comply with the rules of the event and venue
• Not to make bulk ticket purchases through automated systems, bots, or software

5. Enjoyvent's Role

Enjoyvent intermediates the sale of tickets for events offered by the Organiser.

Event content, date, time, venue, price, seating arrangement, age restrictions, and cancellation/refund conditions are determined by the Organiser.

Enjoyvent is not responsible for:

• The conduct of the event
• Content changes
• Cancellations or postponements
• Venue conditions

Responsibility for these matters lies with the Organiser.

6. Cancellations, Refunds, and Changes

Cancellation and refund conditions are determined by the relevant Organiser.

In the event of a cancellation or postponement, the applicable process is run by the Organiser. Enjoyvent technically applies the refund procedure communicated by the Organiser.

The User is responsible for reviewing the relevant event's refund and change conditions prior to purchase.

7. Account Security

The User is responsible for all transactions carried out through their account.

Enjoyvent cannot be held responsible for damages arising from unauthorised use of the account where there is fault on the part of the User.

The User must immediately inform Enjoyvent if they believe the account's security has been compromised.

8. Intellectual Property Rights

All designs, logos, trademarks, texts, images, software, and content on the Site and Application belong to Enjoyvent or its licensors.

Without prior written permission, this content may not be:

• Copied
• Reproduced
• Modified
• Used for commercial purposes

9. Personal Data

By using the Site and Application, the User acknowledges that they have read and understood the Privacy Policy, the Cookie Policy, and the Personal Data Protection Notice (KVKK).

Personal data is processed in accordance with the relevant legislation and the published notices.

Sending commercial electronic messages is subject to the User's explicit consent.

10. Limitation of Liability

Enjoyvent is not responsible for direct or indirect damages that may arise from:

• Technical failures
• Internet outages
• Force majeure events
• Cancellations or changes caused by the Organiser
• Issues caused by the venue

In any case, Enjoyvent's liability is limited to the amount of the relevant ticket.

11. Changes

Enjoyvent may update the provisions of this Agreement at any time.

The updated text takes effect as soon as it is published on the Site.

The User's continued use of the Site or Application means that the updated terms have been accepted.

12. Dispute Resolution

For Users who qualify as consumers, Consumer Arbitration Committees and Consumer Courts are competent.

In other cases, the Istanbul Courts and Enforcement Offices have jurisdiction.

13. Effective Date

This Agreement enters into force when the User gives consent electronically or continues to use the Site/Application.
